Heads of Terms for a Lease
between Wokingham Borough Council and the Hurst Golf Club at the Emmbrook Room,
1) The Lease to be between Wokingham
Borough Council, Civic Offices, Shute End, Wokingham, Berkshire, RG40 1WH (the
Lessor) and Hurst Golf Club (the Lessee)
Demise
& Term
2) The Lease to run for a period of one year on the property shown
edged in red on a plan to be agreed being the Emmbrook Room (which forms one
part of a barn that comprises two function rooms, the other being the Loddon
Room)
Rental
3) The Lessee will pay a rental of
£8,850 per annum exclusive
4) Rental payments will be payable
quarterly in advance on the usual quarter days
Use
5) The property will be used as a
meeting room for Hurst Golf Club members only
6) No alcohol will be sold from the
premises
Specified
Hours
7) The property can be used daily
between the hours of 7.15am and 10pm
Car
Parking
8) The Lessee may use the car park
at Dinton Pastures Country Park in common with Wokingham Borough Council and
other users although on competition days the overflow car park should be used
Alienation
9) The Lease may not be sub-let,
under-let or assigned (in whole or part)
Repairs
& condition for use
10) The Lessee to be responsible for internal repairs and decoration of the premises
11) The Lessee to provide fire prevention equipment at the property and
to arrange for an annual fire safety check to be carried out by a registered
agent and a certificate provided. The cost of this must be met by the Lessee
12) All electrical appliances (including, but not only, fridges,
freezers, electric radiators etc) that are provided at the property must be
tested annually by a NICEIC (or similar organisation) qualified electrician.
The cost of this must be met by the Lessee
Insurance
& Indemnity
13) The Lessee must take out insurance cover against any accident, loss,
fire or theft in respect of equipment, fixtures and fittings belonging to them
or their invitees
14) The Lessee to take out insurance
in respect of injuries, accident or death relating to persons entering or
attending the premises up to a value of £5 million or such other sum that may
be specified by the Landlord from time to time and to further indemnify the Lessor in respect of
such claims.
15) The Lessor is to insure the building
Statutory Regulations
16) The Lessee is to comply with all
statutory/ regulatory requirements relating to the proposed use and to keep the
Council fully indemnified against any breaches
17) The Lessee is to comply with all planning
controls
Alterations
18) The Lessee is not to make any
alterations without the consent of the Lessor
Service
charge
19) The Lessee will pay a due and
fair proportion of all water consumed at the Emmbrook Room and Loddon Room
complex
20) The Lessee will pay a due and
fair proportion of all electricity consumed at the Emmbrook Room and Loddon
Room complex
21) The Lessee will pay a due and
fair proportion towards the cleaning, lighting, heating, maintenance and
supplies of the toilet and disabled toilet at the Emmbrook Room and Loddon Room
complex
22) The Lessee is to pay a due and
fair proportion of business rates payable at the Emmbrook Room and Loddon Room
complex (if applicable)
Toilets
23) The Lessee may use the toilet and
disabled toilet in common with Wokingham Borough Council and other users of the
building
Yield
Up
24) At the end of the lease, the Lessee must yield up the property with
vacant possession in good and substantial repair
25) At the end of the lease, if required by the Lessor, the Lessee must
remove its fixtures and fittings.
Security
of Tenure
26) The Lease to be excluded from the provisions S.24-28 of the Landlord & Tenant Act 1954 relating to security of tenure
Costs
27) The Lessee is to contribute £300 towards the Lessor’s legal costs
Other
28) Any other conditions which the Lessor’s solicitor may deem necessary in formalising the documentation
